Terms of Service
Please read these Terms before using PhotoMark Studio. By downloading, accessing, or using the app or related services, you agree to these Terms and to any terms presented by Apple for App Store purchases.
1. The Service
PhotoMark Studio is a photo watermark and signature design app. It helps you import photos, read photo metadata, create visual watermark layouts, add text, brand marks, camera or lens information, handwritten or uploaded signatures, export edited photos, save templates, and optionally sync personal templates through iCloud.
2. Your Content
You keep ownership of photos, signatures, templates, text, and other content that you create or import into PhotoMark Studio. Content used for photo editing, watermark creation, signature processing, and export is processed on your device. If you enable iCloud template sync, Apple processes the synced template data under Apple's terms and privacy policy.
You are responsible for having the rights and permissions needed to use any photo, logo, signature, text, or other material that you import, create, export, or share. Do not use the app to infringe another person's intellectual property, privacy, publicity, or other rights.
3. Pro Subscriptions and Purchases
PhotoMark Studio may offer a paid Pro subscription, including monthly and yearly auto-renewable plans. Pro may unlock advanced templates, premium brand marks, custom camera and lens information, advanced typography, iCloud template sync, premium export capabilities, and other current or future Pro features shown in the app.
- Purchases are processed through Apple's In-App Purchase system and charged to your Apple Account.
- Subscriptions renew automatically unless canceled through your Apple Account settings according to Apple's subscription rules.
- You can manage or cancel subscriptions in Apple Account settings. You can also use Restore Purchases in the app to refresh eligible entitlements.
- Prices, renewal terms, trial availability, and taxes are shown by Apple before purchase and may vary by region.
- Refund requests are handled by Apple under Apple's applicable refund process.
4. Apple Terms
Apps made available through the App Store are licensed, not sold. Your use of PhotoMark Studio is also subject to the Apple Media Services Terms, Apple's App Store rules, and Apple's standard Licensed Application End User License Agreement unless a custom license is provided.
5. Acceptable Use
You agree not to misuse the app or related services. This includes attempting to bypass subscription access controls, interfering with app or platform security, reverse engineering the app except where allowed by law, submitting unlawful or harmful content, or using the app to mislead others, impersonate another person, or commit fraud.
6. Third-Party Services
Some features rely on Apple services for Photos, iCloud, StoreKit, subscriptions, and App Store account management. These services are governed by Apple's terms and privacy practices. We are not responsible for third-party services outside our control.
7. Availability and Changes
We may update, add, suspend, or discontinue app features or related services. We try to keep the service reliable, but we do not guarantee uninterrupted availability or exact rendering results on every device.
8. Disclaimers
PhotoMark Studio and related services are provided "as is" and "as available." To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. Some jurisdictions do not allow certain disclaimers, so some of these limits may not apply to you.
9. Limitation of Liability
To the maximum extent allowed by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising from your use of or inability to use PhotoMark Studio or related services.
10. Termination
You may stop using PhotoMark Studio at any time. Canceling a subscription stops future renewal but does not ordinarily provide a refund for the current subscription period. Your right to use the app may end if you materially violate these Terms, subject to applicable law.
11. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to make the updated Terms available in the app or on this page. Your continued use of PhotoMark Studio after updated Terms become effective means you accept the updated Terms.
